Article 44 of Law No 5162/2024 introduces a new type of residence permit, allowing third-country nationals to obtain Golden Visa by investing a minimum of 250,000 Euros in a Greek company registered on the Greek National Startup Registry (Elevate Greece).

Requirements:

W

⁠A minimum investment of 250,000 Euros in the company through acquisition of shares in a capital increase or acquisition of bonds.

W

⁠The company is required to create at least 2 new job positions within the first year following the investment and maintain the same number of jobs for a minimum of 5 years.

W

⁠The Startup company must Be Technology Focused.

W

The investment must not exceed the 33% of the company’s capital or voting rights.

W

⁠The investment must be funded with capital transferred from abroad to Greece by the third-country national, the foreign legal entity or by their spouse, civil partner or relatives up to the second degree.

Investments made through a legal entity

  • Domestic legal entity: The third-country national may hold 100% of the company’s shares.
  • Foreign legal entity: A residence permit can be granted to up to three citizens of third countries with at least 33% ownership.

Duration and Renewal of the Residence Permit – Family members

  • ⁠The residence permit is initially granted for 1 year and may be renewed for 2 years each time, provided that the conditions continue to be met.
  • ⁠The permit holder must retain the shares for at least five years. In case they sell the shares, they have the option to reinvest either in another eligible startup or in other investments within two months to maintain their residence permit.
  • ⁠If the initial investment is liquidated or restructured, the permit holder must make a new investment within 2 months to maintain the residence permit.
  • ⁠No employment rights are provided.
  • ⁠The third-country national may be accompanied by family members.
